The following Regulations define the general terms and conditions of sale applicable in our online store available at https://kokietki.pl/en/, operated by Kokietki Maciej Rogulski, Jana Kasprowicza 12d, Łódź 92-781, NIP: 7272564967, REGON: 100941290. The business activity is registered in the Central Register and Information on Business Activity (CEIDG), maintained by the Minister responsible for economic affairs.

1. Scope of application of the regulations

The Regulations apply to all orders placed by Consumers and Entrepreneurs via our online store.

Pursuant to Article 22 of the Civil Code, a consumer is a natural person who concludes a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.

According to Article 43 of the Civil Code, an entrepreneur is a natural person, a legal person or an organizational unit that is not a legal person, but which is granted legal capacity by law and conducts business or professional activity on its own behalf.

Other or supplementary regulations and general terms and conditions used by Entrepreneurs do not apply – they will only become part of the contract if we give our express written consent.

2. Conclusion of the contract

The sales contract is concluded with Kokietki Maciej Rogulski.

The presentation of products in our online store constitutes an offer to conclude a sales contract. To conclude a contract, you must add selected products to your shopping cart and place an order. You can modify the shopping cart and the data entered in the forms before placing your order using the available functionalities and messages displayed during the ordering process.

By clicking the button on the order summary page to confirm and finalize your order, you are placing a binding order for the products in your shopping cart. Upon receipt and registration of your order in our online store's IT system, a sales contract is concluded. After placing your order, you will receive an email from us confirming your order and the conclusion of the contract.

3. Language and rules for consolidating the contract

The sales contract can be concluded in Polish, English, German, French, Latvian, Czech, Slovak, Hungarian, Romanian, Ukrainian and Lithuanian.

We retain the content of the contract and send you order details and our Terms and Conditions by email. You can also view information about your orders through your customer account. The Terms and Conditions are also available on our store's website, allowing you to retrieve, reproduce, and save their content.

4. Delivery of products

In some cases, shipping costs may be added to the listed product prices. Ordered products are delivered via our partner courier companies. Detailed information about available delivery methods, times, and shipping costs is provided during the ordering process and in the information tab on the store's website.

The products offered in the store are sold exclusively via mail order. Personal pickup is not available.

5. Payments

The following payment methods are available in our online store:

  • Cash on delivery upon delivery (depending on the delivery country),
  • Electronic payments via online payment services,
  • Traditional transfer to the store's bank account (processing after payment is received).

6. Right to withdraw from the contract

As stated in the instructions, you have the statutory right to withdraw from the contract.

7. Damage caused during transport

For Consumers: When purchasing remotely, our store bears the risk of accidental damage or loss of goods during transportation. If products are delivered with obvious damage, please report the defect to the carrier as soon as possible and contact us. Delay does not limit your statutory rights, but facilitates the pursuit of claims against the carrier/insurer.

8. Complaints: compliance of the goods with the contract / defects

For Consumers: We are obligated to deliver goods free from defects. If the goods do not conform to the contract, you have the rights set out in Chapter 5a of the Consumer Rights Act (repair, replacement, price reduction, withdrawal). We are responsible for any lack of conformity discovered within 2 years of delivery (unless a longer expiration date is specified).

On similar terms, sole proprietors are entitled to rights in the "quasi-consumer" scope.

Applies to Entrepreneurs: (except quasi-consumers) – liability under warranty is excluded (Article 558 § 1 of the Civil Code).

9. Services provided electronically

To use the store, you need a device with a browser, internet access, and email. We recommend enabling JavaScript and Cookies. Users use the store in accordance with the law and good practices; providing illegal content is prohibited.

We ensure the proper operation of the website in accordance with current technical knowledge and resolve reported issues within a reasonable timeframe. Please send your reports to the contact details above, specifying the type and date of the problem.

10. Code of Good Practice

We have voluntarily complied with the "Trusted Shops Quality Criteria" (link available on the Trusted Shops website).

11. Extrajudicial dispute resolution

Consumers have the option of using out-of-court complaint and redress procedures. Information can be found at www.uokik.gov.pl in the "Amicable Resolution of Consumer Disputes" tab. Using these methods is voluntary and requires the consent of both parties.

12. Final provisions

No provision of these Terms and Conditions violates any consumer rights. In the event of any conflict with applicable law, statutory provisions shall apply.

Polish law applies to contracts with Entrepreneurs, excluding the Vienna Convention (CISG).

In disputes with Entrepreneurs (except quasi-consumers), the exclusive court of jurisdiction is the court having jurisdiction over our registered office.
